These Terms and Conditions ("Terms") govern your use of the website at https://lestari-counsel.info and the professional advisory services offered by Lestari Counsel Sdn Bhd ("Lestari Counsel", "we", "us", or "our"), a company registered in Malaysia with its office at 41 Persiaran Tropicana, Tropicana Golf Resort, 47410 Petaling Jaya, Selangor.
By accessing this website or enquiring about our services, you acknowledge that you have read and understood these Terms. If you do not accept them, please do not use this website or engage our services.
1. About Lestari Counsel
Lestari Counsel provides sustainability strategy advisory services to organisations operating in Malaysia, with a focus on the technology dimensions of sustainability — including Green IT programme design, sustainability disclosure preparation, and posture assessments for technology leaders and sustainability officers.
Our services are directed at corporate and institutional clients. We do not provide services to private individuals acting outside a professional or organisational capacity.
2. Use of This Website
You may use this website for lawful purposes only. In particular, you agree not to:
- Use the website in any way that violates Malaysian law or regulation;
- Transmit unsolicited commercial communications;
- Attempt to gain unauthorised access to any part of the website or its underlying systems;
- Introduce malicious code, viruses, or other harmful material;
- Reproduce or redistribute the content of this website without our prior written consent.

3. Intellectual Property

Nothing on this website grants you a licence to use, reproduce, or adapt our intellectual property for commercial purposes without our written agreement.
Deliverables produced as part of a formal engagement are governed by the written terms of that engagement rather than by these general Terms.
4. Advisory Services — General Conditions
The following general conditions apply to all advisory engagements with Lestari Counsel. Where a written engagement letter or service agreement has been signed, its terms prevail over these general conditions.
4.1 Nature of Our Advice
Our work constitutes professional advisory opinion based on the information available to us at the time of the engagement. Our deliverables — posture notes, programme papers, workshop handbooks — represent our considered professional judgement. They do not constitute legal, financial, or accounting advice, and should not be treated as a substitute for such advice where that advice is warranted.
Sustainability regulations, Bursa Malaysia disclosure requirements, and technology standards evolve continuously. Lestari Counsel accepts no responsibility for changes in regulatory or technical requirements that occur after the delivery of a piece of work.
4.2 Client Responsibilities
The quality of our work depends upon the accuracy and completeness of the information, data, and context that you provide. You agree to provide us with honest and complete information relevant to the engagement. We accept no liability for outcomes resulting from inaccurate or withheld information.
4.3 Fees and Payment
Our published indicative fees are stated in Malaysian Ringgit (RM) and exclude applicable taxes unless otherwise stated. The fees applicable to a specific engagement are confirmed in writing before work commences. Payment terms are set out in the engagement letter. We reserve the right to pause or suspend work where invoiced amounts remain unpaid beyond the agreed payment period.
4.4 Confidentiality
Both parties agree to treat the other's confidential information with reasonable care. We will not disclose your organisation's confidential data to third parties except as required by law, by our own professional advisors under confidentiality obligations, or with your written consent. You agree not to share our unpublished deliverables externally without our written agreement.
4.5 Limitation of Liability
To the extent permitted by Malaysian law, Lestari Counsel's aggregate liability to you in connection with any engagement shall not exceed the total fees paid for that engagement. We exclude liability for indirect, consequential, or exemplary losses, including loss of profits, loss of data, or reputational damage, whether arising in contract, tort, or otherwise.
Nothing in these Terms excludes liability for death or personal injury caused by negligence, or for fraud or fraudulent misrepresentation.
5. Website Content — Accuracy and Currency
We endeavour to keep the content of this website accurate and up to date, but we make no warranty — express or implied — as to its completeness, accuracy, or fitness for any particular purpose. We reserve the right to change or withdraw content at any time without notice.
Nothing on this website constitutes a binding offer to provide services at any stated price or on any stated timeline. Formal engagements are constituted only by written agreement.
6. Third-Party Links
This website may link to external resources — regulatory publications, reporting frameworks, or industry guidance — for your convenience. Lestari Counsel is not responsible for the content, accuracy, or privacy practices of any linked external website. The presence of a link does not constitute endorsement.
7. Data Protection
Our collection and use of personal data is governed by our Privacy Policy, which forms part of these Terms. Our use of cookies is described in our Cookie Policy. By using this website, you consent to the data practices described in those documents.
8. Governing Law and Disputes
These Terms are governed by the laws of Malaysia. Any dispute arising from these Terms or from the use of our website shall be subject to the exclusive jurisdiction of the courts of Malaysia, unless resolved by mutual agreement prior to proceedings being issued.
We prefer to resolve any concern through direct communication before formal proceedings. If you have a concern regarding any aspect of our services or conduct, please write to us first at [email protected].
9. Changes to These Terms
We may revise these Terms from time to time. The revised version will be posted to this page with an updated effective date. Your continued use of the website following a revision constitutes acceptance of the amended Terms. For material changes, we will note the revision prominently on this page.
